Processtailor Engineering Limited Company ("PROCESSTAILOR", "Processtailor", "we", "us" or "our") is the operator of the Processtailor platform. We offer our Services through the website located at https://processtailor.com / ("Website") and by other means we deem appropriate (the Website and all services provided by us are hereinafter referred to as the "Services").
These Terms of Use (the "Terms of Use" or "Agreement") set forth the legally binding terms for the use of our Services, both for a "Visitor" who is just accessing and browsing the Website and for a "Member" who has paid for any of the Services offered. Visitors and Members are referred to as "User", "Listener" or "you" in this Agreement.
The terms under which PROCESSTAILOR collects, uses, and discloses information collected from you are detailed in the PROCESSTAILOR Privacy and Personal Data Protection Policy (published on https://processtailor.com/privacy-policy). The Privacy and Personal Data Protection Policy and the https://processtailor.com/ terms of the Website are incorporated by reference and form part of these Terms of Use. All additional terms, guidelines and rules in connection with these Terms of Use are also incorporated by reference.
PLEASE READ THESE TERMS OF USE CAREFULLY, WHICH CONTAIN AN AGREEMENT REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS.
If you do not agree to these Terms of Use, do not register, access or otherwise use any of our Services. If you have any questions, please contact us at info@processtailor.com. If you have any doubts about any of your rights and obligations arising from these Terms of Use, you are advised not to proceed without consulting a legal advisor.
Your Consent and Acceptance of These Terms of Use
YOU ACKNOWLEDGE AND AGREE THAT THESE TERMS OF USE, AS AMENDED FROM TIME TO TIME AND PUBLISHED ON https://processtailor.com.tr/cookies-policy/, INCLUDING OUR PRIVACY AND PERSONAL DATA PROTECTION POLICY (PUBLISHED IN https://processtailor.com/terms_of_use) AND COOKIE POLICY (PUBLISHED IN https://rocesstailor.com/privacy-policy), CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND PROCESSTAILOR.
PROCESSTAILOR provides the Services to you, the User, subject to your compliance with these Terms of Use and any other written agreements between you and PROCESSTAILOR.
Although we will endeavor to notify you when material changes are made to these Terms of Use, you acknowledge and agree that it is your responsibility to review these Terms of Use from time to time and to be informed of any changes. Such changes will be effective immediately and will be effective from the date of publication for disputes in connection with this Agreement. Your continued use of the Services after a change to the Terms of Use has been made constitutes your acceptance of that change.
Event means thematic courses, trainings, seminars, conferences, master classes, lectures, webinar or online consulting format and other similar remote Events organized by the Company or provided through the Company's Learning Management System or other services of the Company's Website, or their recordings.
Processtailor's Learning Management System (LMS) is a section of the Company's Website that the User has access to after registering his/her Personal Account and provides users with access to training resources, training materials, courses, assignments, tools, Event details, other services and opportunities provided by the Company.
General Restrictions
You must be at least 18 years old to use our services.
You may not use the Services in any manner that is in harm's way to PROCESSTAILOR or any other person or entity, and in any manner prohibited by applicable law in the jurisdiction in which you are bound by these Terms of Use or in which your use is prohibited by these Terms of Use.
You agree not to record, modify, edit, copy, sell, license, distribute, publish, adapt, reproduce or reuse the content on the Website and any Service for any public or commercial purpose.
User Account
You need an account ("User Account") for most activities on PROCESSTAILOR, including subscribing to and registering for a course or training offered on the Website.
The User's Personal Account is a section that is created using the software features of the Website, contains the User's personal data and provides access to our Learning Management System. Access to the User's Personal Account is granted after the registration procedure is completed. A link to the Internet connection for registration of the User's Personal Account is sent to the User's e-mail address specified during registration in the Event.
Note that you must be at least 18 years old to open a User Account. If you are younger than the required age, you will not be able to create a User Account; however, we encourage you to invite a parent or guardian to open a User Account and help you enroll in courses that are appropriate for you. If we determine that you are under the age required in your country to use the online services, but have created a User Account, your User Account will be terminated.
BY PROVIDING YOU WITH THE OPPORTUNITY TO CREATE A USER ACCOUNT, YOU ACKNOWLEDGE AND AGREE THAT YOU WILL HAVE NO OWNERSHIP OR OWNERSHIP RIGHTS IN THE USER ACCOUNT AND THAT ALL RIGHTS IN AND TO ANY USER ACCOUNT OR USER PROFILE ARE AND WILL ALWAYS BELONG TO AND INURE IN FAVOR OF PROCESSTAILOR.
You must provide us with complete, accurate and up-to-date information (including your email address) when creating and using your User Account and keep your personal data accurate and up-to-date at all times. You can correct or update or withdraw your personal data at any time. FOR MORE INFORMATION ON THE PROTECTION OF PERSONAL DATA, PLEASE REFER TO OUR PRIVACY AND PERSONAL DATA PROTECTION POLICY.
You are solely responsible for anything that occurs on your User Account, including your User Account and any loss or damage (to us or anyone else) caused by someone using your User Account (whether or not with your permission). You must take all reasonable steps to keep your password confidential and secure, and you must notify us immediately if you have reason to believe that your password is known to others, or if there is any unauthorized use or potential use of the password.
You may request deletion of your User Account by sending an email request to info@processtailor.com. Please note that if you request deletion of your User Account, you may no longer be able to access and use the Services and any content you submit to us.
PROCESSTAILOR does not and will not accept the transfer of your User account or User profile to anyone else. Therefore, you may not give, buy, sell, negotiate, barter, market, exchange, offer for sale, license, transfer or otherwise dispose of any of your rights, responsibilities or obligations under these Terms of Use, in whole or in part, without the prior written consent of PROCESSTAILOR. Any attempt to do so will be invalid and ineffective.
Course Registration
Pursuant to our agreement with our Speakers, we are granted the right to provide online courses (each, a "Course") to our Users and to make the Course available to Users who have registered. Note that the Course Content belongs to the speaker and PROCESSTAILOR and is not transferred or assigned to you under any circumstances due to your registration.
For the purposes of this agreement, the term "Content" includes literary works, texts, lectures, presentations, speeches, computer programs, mobile programs, and applications, as well as audio and visual works (video courses, infographics, phonograms, images, trademarks, and service marks), trade names and trade names, trademarks, logos, hypertext links, and parts thereof, information, widgets, and other objects published on the Website or within the Course, or means subjects of intellectual activity, including materials, and equivalent means of personalization.
When you enrol for a Course, you are granted the right to view the Course through the Website, subject to your payment of the full fees associated with the Course. You are licensed for the Courses, but the Courses are not sold to you. This means that you are legally granted a limited, personal, non-exclusive, non-transferable license through our Website to access and view the Courses (and related Content) solely for personal, non-commercial, informational purposes, all in accordance with these Terms of Use and any conditions or restrictions specifically associated with such particular Course. All other uses are strictly prohibited.
The right to view the Course does not grant you the right to download and/or resell the Course in any way, including sharing your User Account information, illegally downloading and/or sharing the Course in any way. You may not reproduce, redistribute, transmit, assign, sell, publish, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer the Course or any portion thereof.
When you complete a Course, you will receive a certificate of completion that you can share with your friends, relatives, colleagues and potential employees. Certificates of completion help you show off your achievements. Note, however, that PROCESSTAILOR is not an accredited body, and as a result, certificates cannot be used for official accreditation.
You consent to PROCESSTAILOR using the above information to analyze trends, administer our Website, track users' movements, and gather broad demographic information for statistical purposes.
By enrolling in a Course, you expressly agree that we may collect, use, store and otherwise process your personal data for the purpose of providing you with access to the Course and related activities and communications you have agreed to participate in. You may be required to provide us with additional personal information in order to receive news, additional information, and other useful information about our Courses from PROCESSTAILOR. You acknowledge and agree that we may collect, use, store, and otherwise process your personal information and share such data with third-party service providers for the purpose of improving or providing our Services, subject to our Privacy and Personal Data Protection Policy.
Changes to Courses
Our first priority is to provide you with qualified Courses, but sometimes unexpected situations may arise. We reserve the right to reschedule, modify, or even cancel Courses offered or make changes to the agenda of the Course. Please note that in this regard, our Services are subject to the Disclaimer and Limitation of Liability sections below.
Your Participation in the Course
You may be offered the opportunity to post comments, upload your work, and other content in Course groups and on social media such as Facebook (the content you submit will be referred to as your "User Review"). User Reviews are intended to start a discussion. When you choose to post a User Review, you retain all ownership rights in your User Comments, but you grant us an irrevocable, perpetual, non-exclusive, fully paid-up, royalty-free, transferable, sublicensable, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use such User Review.
Any User Comments you post on our Website or throughout the Courses (on our Website or other social media platforms) are your sole responsibility. We reserve the right to remove your User Comments for any reason without any liability to you or any third party, including any User Comments that we believe violate these Terms of Use.

When you interact directly with other Users or our speakers, you should be careful about the types of personal information you share. PROCESSTAILOR does not control what Users and their speakers do with the information they obtain from other Users throughout our Courses or otherwise. For your safety, it is recommended that you do not share your email and/or other personal information.
Select Courses allow you to ask speakers questions and submit reviews of courses. For certain Courses, speakers may ask you to submit content as "homework" or as a test. It is advisable not to send anything that does not belong to you.
Fees
PROCESSTAILOR offers the Courses for a fee. By subscribing to a Course, you agree to the pricing, payment, and billing policies applicable to such fees and payments as described on the Website or in any policy of a third-party payment service. By continuing to pay for the Course you have subscribed to, you authorize us to charge (or process other payment methods) to your debit or credit card for the full price applicable to the Course you have selected.
You agree and agree to pay all fees incurred by you, including any applicable taxes, in accordance with these Terms of Use and the billing terms in effect at the time the fee is due or payment is made. Please note that as a general rule, payment for the Course you have subscribed to must be made no later than one day before the start date of the Course.
You acknowledge that PROCESSTAILOR may use certain third-party providers (such as Iziyco, PayPal, Stripe, Square, etc.) to collect or otherwise process such fees or payments. Any additional and separate fees or obligations that you incur directly with such third party are your sole responsibility. When you pay for a subscription, you agree not to use an invalid or unauthorized payment method.
PAYMENT FOR ANY SUBSCRIPTION/MEMBERSHIP IS FINAL AND YOUR PAYMENT WILL NOT BE TRANSFERRED OR REFUNDED UNDER ANY CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, TERMINATION OF YOUR USE OF OUR SERVICES FOR ANY REASON OR NO REASON, TERMINATION OF THIS AGREEMENT, AND/OR TERMINATION OF SERVICES.
When you purchase a Course subscription, you agree not to use an invalid or unauthorized payment method. Any use of such invalid or unauthorized payment methods will allow us, at our sole and absolute discretion, to cancel the payment. Unless otherwise stated, all fees are in EUROS, U.S. dollars and/or TRY.
Refund Policy
PROCESSTAILOR will not issue refunds for a Course you have subscribed to under any circumstances other than the following:

In the event that the Course you have subscribed to is cancelled by PROCESSTAILOR, the payment for the Course will be refunded to your account.
To request a refund , you need to contact us at info@processtailor.com and follow our information and instructions. We will endeavour to reimburse you within 10 business days from the date you provide the required notice. However, we reserve the right to postpone the refund if you do not follow our instructions.
Without prejudice to any of the foregoing, please note that you will not be entitled to any refund if your User Account is banned or your access to a Course is disabled due to your breach of these Terms of Use or our other policies.
Your Behavior During the Services
You are solely responsible for your interaction with other Users (including, for the purposes of this section, Course speakers), whether online or offline. You acknowledge and agree that PROCESSTAILOR is not responsible or liable for the conduct of any User.
Your conduct while using our Services is solely at your own risk, and you agree that you will not post, post, upload, transmit, distribute, disseminate or otherwise make available to any User or speakers the following:

Material that is determined, in PROCESSTAILOR's sole discretion, to be harmful, abusive, defamatory, libelous, obscene, infringing, embarrassing, unwanted, invasive of the privacy rights or publicity of others, hateful, or racially, ethnically or otherwise offensive, objectionable or otherwise objectionable;

material that promotes or influences other criminal acts (including those against people, animals, and property);

material or information that infringes any copyright, trademark, patent, trade secret, privacy, publicity or other rights of others;

files that contain any malicious code, including viruses, spyware, Trojan horses, worms, time bombs, cancelbot, corrupted data, or that may in any way damage or interfere with the operation of the Website and Services, other Users' and speakers' access to the Website or Services and/or Users' and speakers' computers;

material that contains pornographic images or texts, or that may be offensive to minors;

pyramid schemes, chain letters, unsolicited email, spam, or messages sent without consent;

material that promotes the use of illegal drugs or encourages the use of ammunition, fireworks, or any destructive device or explosive;

materials advertising gambling and betting.
When using the Services, you also agree not to:

defamation, abuse, harassment, stalking, threatening, bullying, or otherwise violating the legal rights of others;

violate any applicable laws or regulations, or promote or encourage any illegal activity;

impersonate another User or create a false identity, including, but not limited to, identities that falsely indicate that the user is another user, celebrity or other public figure, or a representative of PROCESSTAILOR;

use fake email headers or otherwise manipulate identifiers to disguise the origin of any content;

gain or attempt to gain unauthorized access to the Services, other Users' account or profile information, or computer systems and/or networks connected to the Website and our other Services;

make false complaints to PROCESSTAILOR administrators through the Services;

take any action (as determined in PROCESSTAILOR's sole discretion) that imposes or may impose an unreasonable or disproportionately large load on PROCESSTAILOR's (or its affiliates' or third-party providers') infrastructure;

carry out fraudulent transactions;

Creating multiple accounts to participate in our Services;

use the Services for betting or gambling of any kind;

transmit any material that you know, or reasonably should know, that it must not be lawfully reproduced, displayed, used and/or distributed;

Obtain, collect or store personal information or data of other Users, speakers or our partners;

and perform any blocking actions similar to any of the above.
PROCESSTAILOR reserves the right, but has no obligation, to monitor or be involved in disputes between you and other Users (including speakers of the Course) and use your common sense and best discretion when interacting with others, including when posting or publishing content or personal information or other information. You also agree that you are responsible for all data obligations you incur due to the use of our Services.
Intellectual Property Intellectual Property Ownership
You agree that PROCESSTAILOR owns or has a license to all right, title and interest in and to the "Content" that it makes available through the Services.
PROCESSTAILOR reserves all rights to the Content except for the rights specifically listed herein as licensed to you. You are only permitted to use the content as expressly authorized by PROCESSTAILOR.
The User does not object to the Company's use of any means (audiovisual recording) to record the Event in which the User is present, in particular, where there are video and photo images and other personal data.
Your Restrictions
By using the Services, you agree, represent, and agree not to engage in, permit any other person or entity to engage in, or otherwise relate to or be a part of any of the following restricted activities:
Market, share, distribute, offer to sell, sell or otherwise reproduce or copy the Website, Services or Content in any way incompatible with the usage rights granted to you by PROCESSTAILOR;
remove any valid and relevant identification, copyright, trademark or other notice associated with PROCESSTAILOR's intellectual property or other proprietary rights;
attempt to access the source or destination code of the Website or any Service by any means, including reverse engineering, or by reducing them to a form that can be read without the use of a computer, unless any applicable statute or law specifically prohibits such restrictive language;
edit, modify, modify the Website and Services (including the creation of any derivative works or other works);
create code, software, or other program that contains any element of the Website and Services;
Attempt to infiltrate, distort or otherwise access the destination or source code of the Website and Services for any personal or commercial purpose, and disrupt or attempt to disrupt the operation of the Website and Services in any way
Rights Regarding the Content You Submit
If PROCESSTAILOR offers you the ability to submit your own content to the Services (such content, which will include User Comments, hereinafter referred to as "User Submitted Content"), you are deemed to be the owner of the User-Submitted Content. It is your obligation to ensure that the User Submitted Content you submit does not infringe any third party rights, and you agree to be responsible for any such violations and indemnify PROCESSTAILOR against any third party claim.
PROCESSTAILOR does not claim ownership rights in any User Submitted Content that you may submit or make available through the Services. However, to the extent that you submit User Submitted Content, you automatically grant (and confirm and warrant that you have the right to provide) to PROCESSTAILOR an irrevocable, perpetual, non-exclusive, fully paid, royalty-free, transferable, sublicensable, worldwide license to:
use, reproduce, distribute, remove, and analyze your User Submitted Content as PROCESSTAILOR deems necessary or appropriate for any purpose connected with the operation of the Services;
copy, modify, and reproduce User Submitted Content for marketing, promotional, and/or other purposes in any medium in connection with PROCESSTAILOR or the Services;
use, edit, modify, reproduce, distribute, prepare derivative works of, display, publish or otherwise make available User Submitted Content in connection with any feature of the Services;
Delete any or all of the User Submitted Content from the Services, intentionally or unintentionally, for any reason or no reason at all, without any liability to you or any other party, and to enable Users of the Services or Services to share or post your User Submitted Content on third-party sites, including, but not limited to, social networking sites.
To the extent that you submit any unsolicited concepts, ideas, or suggestions, whether through the Services or otherwise, as an example and without limitation for any features or functionality for the Services (collectively, "Ideas"), you agree that such Ideas are non-confidential, non-proprietary, and that PROCESSTAILOR shall not be responsible for any disclosure of such Ideas. To the extent of all your rights to the Ideas, you grant PROCESSTAILOR an irrevocable, perpetual, non-exclusive, irrevocable, perpetual, non-exclusive right to incorporate, use, publish and exploit such Ideas for any purpose, commercial or otherwise, including, but not limited to, incorporating such Ideas into the Services or any PROCESSTAILOR product or service, without any compensation or accountability to you and without further recourse to you, You grant and agree to fully license, royalty-free, transferable, sublicensable, worldwide.
Limitation of Liability; Disclaimer
PROCESSTAILOR and any of its affiliates, subsidiaries, officers, directors, shareholders, employees, licensors, distributors, sublicensees, agents or subcontractors (collectively, the "PROCESSTAILOR Parties") will use their best efforts to ensure that the availability of the Services is uninterrupted and that transmissions are error-free. However, due to the nature of the internet, this cannot be guaranteed.
YOU EXPRESSLY AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR THE RISKS OF YOUR USE OF THE SERVICES. ALL MATERIALS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT. NO WARRANTY IS MADE THAT (A) OUR SERVICES WILL MEET YOUR REQUIREMENTS, (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF OUR SERVICES WILL BE EFFECTIVE, ACCURATE, OR RELIABLE, AND/OR (D) THE QUALITY OF ANY SERVICES OR INFORMATION AVAILABLE TO YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS OR BE FREE FROM INACCURACIES, ERRORS, OR DEFECTS.
THE CONTENT OF OUR SPEAKERS' LECTURES IS NOT MODIFIED OR MODIFIED FOR LEGAL OR OTHER ISSUES. NO EDITORIAL CONTROL IS CARRIED OUT ON THE COURSES AVAILABLE ON OUR WEBSITE AND THEREFORE THE RELIABILITY, VALIDITY, ACCURACY OR AUTHENTICITY OF THE COURSES ARE NOT GUARANTEED IN ANY WAY. SPEAKERS ARE NOT HIRED OR EMPLOYED BY PROCESSTAILOR, AND PROCESSTAILOR HAS NO RESPONSIBILITY OR LIABILITY FOR INTERACTIONS BETWEEN SPEAKERS AND USERS PARTICIPATING IN THE COURSE. ARISING OUT OF OR RELATED TO THE CONDUCT OF SPEAKERS OR USERS
PROCESSTAILOR IS NOT RESPONSIBLE FOR ANY DISPUTES, CLAIMS, LOSSES OR DAMAGES.
BY USING THE SERVICES, YOU MAY BE EXPOSED TO CONTENT THAT YOU FIND OFFENSIVE, INDECENT, OR OBJECTIONABLE. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE PROCESSTAILOR PARTIES HAVE NO OBLIGATION TO WITHHOLD SUCH CONTENT FROM YOU AND HAVE NO OBLIGATION FOR YOUR ACCESS TO OR ENROLLMENT IN ANY COURSES.
PROCESSTAILOR MAKES NO COMMITMENT TO UPDATE ITS SERVICES. PROCESSTAILOR HAS NO RESPONSIBILITY OR LIABILITY FOR THE DELETION OR FAILURE TO FUNCTION OF DATA OR OTHER CONTENT USED OR UPLOADED BY THE SERVICE. PROCESSTAILOR RESERVES THE RIGHT TO TERMINATE USER ACCOUNTS THAT HAVE BEEN INACTIVE FOR AN EXTENDED PERIOD OF TIME. PROCESSTAILOR RESERVES THE RIGHT TO MODIFY THE SERVICE (OR ANY PART THEREOF), TEMPORARILY OR PERMANENTLY, WITH OR WITHOUT NOTICE. YOU AGREE THAT PROCESSTAILOR SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION OR DISCONTINUANCE OF THE SERVICE.
THE LIMITATIONS OF LIABILITY CONTAINED IN THIS SECTION APPLY TO ANY DAMAGE OR INJURY CAUSED BY ANY FAILURE TO PERFORM, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS, ALTERATION OR USE OF THE WEBSITE AND SERVICES DUE TO BREACH OF CONTRACT, TORTIOUS ACT, NEGLIGENCE OR ANY OTHER ACTION.
THE PROCESSTAILOR PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, UNINTENTIONAL DAMAGES (INCLUDING LOSS OF REVENUE, LOSS OF GOODWILL, OR LOSS OF DATA) OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, ANY LOSS OF USE OR DATA, WHETHER OR NOT THE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND BASED ON ANY CONSIDERATION OF LIABILITY, IN NO EVENT SHALL HE BE LIABLE TO YOU OR ANY THIRD PARTY.
BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, THE LIABILITY OF THE PROCESSTAILOR PARTIES SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
You fully accept the risks associated with your use of the Services. You acknowledge and agree that the exclusive remedy for any dispute with the PROCESSTAILOR Parties is to discontinue use of the services. You further agree that no liability of the PROCESSTAILOR parties to you shall exceed the amount, if any, paid by you for the services giving rise to such liability.
You agree that any claim you may have arising out of or related to your relationship with PROCESSTAILOR must be filed within one year after such claim arises or your claim will be permanently barred.
Compensate
You agree to defend, indemnify and hold harmless PROCESSTAILOR from and against all liabilities, claims, losses, costs and costs, including attorneys' fees, arising from:

PROCESSTAILOR reserves the right, at its own expense, to assume the exclusive defense and control of any matter that would otherwise be indemnified by you, if you cooperate with PROCESSTAILOR to present the present defenses.

The Services may direct you to other websites or contain references to information, materials, and/or services provided by other parties. These other websites and parties are not under the control of PROCESSTAILOR and you acknowledge and agree that PROCESSTAILOR is not responsible for the accuracy, copyright compliance, legality, decency or any other aspect of the content of such websites and that PROCESSTAILOR is not responsible for errors or omissions in references to other parties or their products and services. Any such link or reference is provided for convenience only and does not imply endorsement, opinion, or association by PROCESSTAILOR with respect to the website or the party, or any warranty, express or implied.

At some point, our Services may include advertisements that may target content or information on the Services, queries made through the Services, or other information. The types and scope of advertisements on the Services may also change over time. In consideration of our provision of the Services to you, you agree that we and our third-party providers and partners may place advertisements on or in connection with the display of content or information on our Services. If you wish to disable, re-enable, and/or customize alerts, you should refer to your compatible device's "Settings" page (or any similar page).
While we use commercially reasonable efforts to provide notices in a timely manner, PROCESSTAILOR cannot guarantee the time of delivery of notices. You acknowledge and agree that PROCESSTAILOR cannot guarantee the time of transmission of warnings and their content, and you hereby waive any claim against PROCESSTAILOR in respect of non-transmission, delay and/or any errors in content of the warning. You further acknowledge and agree that we shall not be liable for any action taken or not taken by you or any third party pursuant to a notice.
Suspension and Termination of Services
Although PROCESSTAILOR aims to make the Services as accessible as possible, the Services may be interrupted from time to time due to scheduled maintenance or upgrades, emergency repairs, or failure of telecommunications connections and/or equipment.
PROCESSTAILOR reserves the right to terminate, suspend or modify any service or any feature of the Services at any time, for any reason or no reason, with or without notice to you.
In addition, PROCESSTAILOR may terminate and/or suspend your use of the Services for violation of these Terms of Use or any other policies related to the Services (including the policies of the affiliates accessible by the Services). Without limiting the foregoing, your access to the Services may be terminated without notice if PROCESSTAILOR believes, in its sole discretion, that you are under the age of eighteen (18) and do not have the permission of your parent or guardian to register and/or access the Services. You agree that PROCESSTAILOR shall not be liable for any loss or damage arising directly or indirectly from any such termination, suspension or modification, that you will no longer have access to the services and that you will have no right to a refund of any money paid to PROCESSTAILOR.

If you are experiencing a technical problem with the Services, including any Application, you may request technical support by writing to info@processtailor.com. When writing to us, please let us know which Course(s) you are subscribed to. We will try our best to help you resolve any technical issues, but PROCESSTAILOR does not guarantee that it will resolve all technical issues and specifically waives it.
Complaints
If you have any complaint, claim or dispute relating to the Website and/or Services, you must submit such complaint in writing to PROCESSTAILOR as soon as practicable after the occurrence of the event referred to in the complaint. Complaints can be emailed to info@processtailor.com with the most possible explanation and details.
Era
PROCESSTAILOR may assign this Agreement, in whole or in part, at any time. You may not assign, transfer, or sublicense any or all of your rights or obligations under this Agreement without the express prior written consent of PROCESSTAILOR.
Governing Law
This Agreement (and any dispute or claim arising out of or in connection with the Agreement or its subject matter, [including any non-contractual disputes, claims, and arbitration agreement]) shall be governed by and construed in accordance with the laws of the Republic of Turkey.
You must comply with all applicable laws, statutes, ordinances, and regulations relating to your use of the Website and Services. Although the Services are accessible worldwide, PROCESSTAILOR makes no representation that the materials in the Services are appropriate or available for use in locations outside of the United States, and access to such materials from territories where their content is illegal is prohibited. Those who choose to access the Services from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws apply.
Notifications
All notifications to the User shall be in writing and shall be made by e-mail or registered mail with return receipt requested. The parties agree that all correspondence relating to this Agreement shall be conducted in English and Turkish. Notices to PROCESSTAILOR should be sent to the attention of Customer Service to the address info@processtailor.com if it is by e-mail, or by conventional mail to the address below. Notices to you may be sent to the email or postal address you provide as part of your account or user profile, if you have one. In addition, notices or messages may be posted through the Services to notify you of changes to the Services or other important matters, and such postings will be deemed to have been served on you at the time of posting.

Entire Agreement
This Agreement constitutes the entire understanding and understanding between you and PROCESSTAILOR with respect to the subject matter hereof and supersedes all prior agreements and understandings of the parties with respect to such subject matter.
No Waiver
In the event that you violate these Terms or any of our policies and PROCESSTAILOR does not take any action, PROCESSTAILOR will still have the right to exercise its rights and remedies in any other case where you violate these Terms of Use.
Severability
If any part of these Terms of Use is determined to be invalid or unenforceable, the invalid or unenforceable provision will be deemed superseded by an enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms of Use will remain in full force and effect.
Force Majeure
You acknowledge and agree that in no event shall PROCESSTAILOR be liable for any event beyond our reasonable control (including, but not limited to, acts of any government or authority, embargo, revocation of any license or approval, failure of any power supply, theft, damage caused in bad faith, state of war, terrorism, natural disasters, internet outages, and similar force majeure).
Miscellaneous Provisions
Nothing in this Agreement shall be construed as creating any agency, arrangement, partnership, joint venture, fiduciary relationship, employer-employee relationship, or any similar relationship between you and PROCESSTAILOR.
Nothing contained in this Agreement violates our right to comply with governmental, court, and law enforcement requests or requirements of PROCESSTAILOR with respect to your use of the Services or information provided to or collected by PROCESSTAILOR in connection with such use.
All headings, subheadings, or section headings contained in this Agreement are included for convenience only and in no way define or explain any section or provision contained in the Agreement.
PROCESSTAILOR and the User confirm that the Event is held only for a limited number of Users and is not open to the public (unless otherwise agreed by the Parties). Trainees/Trainers, methodologists, other Users and Company representatives who can see each other can participate in the events.
PROCESSTAILOR informs the User that a video has been created during the Event that it has been recorded. The registration of the event may contain information about the personal data of Users, including but not limited to: last name, first name, family name, nickname, photo, profile picture (avatar). Event registrations, together with the specified personal data, may be made available in the User's Personal Account and in the Company's Learning Management System (LMS), to all participants of the Event and to Users who have purchased a particular Event registration.
PROCESSTAILOR has the right to record an event, create an audiovisual record and alienate it to third parties.
PROCESSTAILOR has the right to notify the User at the time of registration / confirmation / payment of the fee for participation in the Event, / during / after the Event, including by independently contacting the user by e-mail or phone number, including mobile messengers (Telegram, WhatsApp, etc.) specified by the User during registration on the Website. and/or registration in the User's Personal Account or through external communication channels (for example, social networks through which the User may register).
